CS/CS/HB 1025 (2008) -  Compensation for Wrongful Incarceration

Creates "Victims of Wrongful Incarceration Compensation Act"; provides that person who has been wrongfully convicted of felony offense & incarcerated within DOC as result of that conviction may be financially compensated if determined to be eligible; provides conditions which constitute eligibility for compensation under act; defines term "actually innocent"; provides for judicial finding of eligibility, amount of compensation, & disbursement of funds; provides for separate judicial finding regarding attorney’s fees & costs; provides criteria for judicial findings; provides that proceedings are intended to be nonadversarial; provides duties of DFS & CFO; requires specific request regarding release of funds; authorizes DFS to make specified payments; requires executed release & waiver as condition precedent to tender of payment; provides procedures & requirements with respect to payment; provides for legislative redress; provides for waiver of specified tuition & fees for claimants compensated under act; provides requirements with respect to educational benefits; authorizes appointment of public defender to assist with process of expunging specified records; prohibits government entities from charging fees for implementation of expunction provisions; provides that Legislature is not deemed to have waived any defense of sovereign immunity or increased limits of liability as result of act or payment of claim thereunder; provides legislative intent with respect to amounts awarded under act.
