HB 871 (2009) -  Retail-Theft Diversion Programs

Requires law enforcement officer who has probable cause to believe that defendant has committed retail theft to issue notice to appear in lieu of arresting him or her; authorizes state attorney to establish retail-theft diversion program to divert defendants from criminal prosecution if defendant meets certain criteria; provides eligibility criteria for program; requires state attorney to mail notice to appear to defendant upon referral to diversion program; provides conditions that each participant in retail-theft diversion program must complete; provides that defendant may be prosecuted for retail theft if all conditions in program are not fulfilled; authorizes fee from each program participant, but limits fee.
