CS/HB 1493 (2009) -  Substance Abuse and Mental Health Services

Establishes priority populations of persons who are eligible for services funded by DCFS; deletes provision that authorizes department to establish pilot project to serve certain persons who qualify to receive substance abuse or mental health services in specified district; provides that it is unlawful for unlicensed agency to act as substance abuse service provider; revises requirements for license application; provides that crisis stabilization unit is exempt from licensure; provides that ch. 397, F.S., does not limit practice of ARNP who provides substance abuse treatment; provides that substance abuse programs operated directly or under contract by DJJ are subject to licensure & regulation; revises licensure process; authorizes DCFS to issue probationary, regular, & interim licenses; requires DCFS to notify certain applicable agencies of any licensure inspections of service providers; requires that fines collected as administrative penalties be deposited in Operations & Maintenance Trust Fund of department rather than Substance Abuse Impairment Provider Licensing Trust Fund; revises requirements for suspending or revoking license; revises minimum guidelines for service provider's quality improvement program; specifies that medication treatment service providers are providers of medication-assisted treatment services for opiate addiction; requires service providers that provide medication-assisted treatment for other substance abuse disorders to provide counseling services; authorizes RN, ARNP, & LPN to deliver medication, other than methadone, for purpose of medication-assisted treatment for opiate addiction under certain conditions; requires licensed service provider that provides medication-assisted treatment to adopt written protocols; provides that inmate substance abuse programs are exempt from level 2 background screenings.
