CS/HB 7139 (2009) -  Drug Court Programs

Specifies criteria considered before sentencing person to postadjudicatory treatment-based drug court program; provides for hearings on violations of probation or community control by program participants; requires circuit courts to report certain data relating to drug court programs; specifies that nonviolent offense is mitigating circumstance justifying departure from sentence if qualified defendant is amenable to drug court; authorizes court to place certain nonviolent felony offenders into postadjudicatory treatment-based drug court program; authorizes court to place certain nonviolent felony offenders who violate their probation or community control into postadjudicatory treatment-based drug court program; authorizes court to place certain nonviolent felony offenders into pretrial intervention treatment-based drug court program; requires OPPAGA to evaluate drug court programs & report.
