HB 1375 (2010) -  Motor Vehicle Franchise Agreements

Motor Vehicle Franchise Agreements: Revises provisions governing franchise agreements between motor vehicle manufacturer, distributor, or importer & motor vehicle dealer; prohibits DHSMV from renewing license of manufacturer, factory branch, distributor, or importer unless licensee complies with specified provisions; requires such licensee to provide affidavit to department regarding provisions of its existing franchise agreements; provides for dealer to make immediate request for payment for loss if there is public announcement of discontinuance of line-make; prohibits requiring existing motor vehicle dealer to enter into site control agreement or exclusive use agreement; authorizes certain motor vehicle dealer associations to apply for injunctive relief or to seek declaration & adjudication of their rights.
