CS/HB 1279 (2011) -  Costs of Prosecution

General Bill by Criminal Justice Subcommittee and Kreegel
Costs of Prosecution: Provides for remittance of costs of prosecution to specified trust fund; provides for allocation of funds in certain circumstances; provides for collection; provides for withholding of unpaid costs from return of cash bond; requires notice on bond forms of possible withholding; provides liability for cost of prosecution for persons whose cases are disposed of under specified provisions; requires courts to impose costs of prosecution & investigation; requires that costs of prosecution & investigation not be converted to court-ordered community service; clarifies types of cases from which clerk of court must collect & dispense cost payments; requires clerk of court to assign first of any fees or costs collected as payment for costs of prosecution; provides for assessment of costs of prosecution against juvenile adjudicated delinquent or who has adjudication of delinquency withheld.
