Explanations of Vote:

  • Joyner -
    Opposition from law enforcement and my concern that violent criminals will be harder to arrest are the primary reasons why I voted against House Bill 155. Violent criminals' mission in life are to tear down the walls of decency and to disrupt the lives of everyday people. This legislation, by significantly limiting the access of law enforcement officials to the records of second-hand gun sales---limitations that do not exist on first-time gun sales---is a wrong-headed step that will make it harder for our courts to prosecute our state's most violent criminals. The lists are currently helping police solve crimes. Considering that Florida leads the nation in violent crime, I simply can not support any effort that handcuffs cops and gives criminals another leg-up.

    I fully support and defend our Second Amendment rights. However, opposition from law enforcement and my concern that violent criminals will be harder to prosecute are primary reasons why I voted "no". This bill significantly limits the access of law enforcement officials to the records of second-hand gun sales, and will "handcuff" cops and prosecutors in the pursuit of criminal justice. Further, this bill violates Article I, s. 24, Fla. Con., by prohibiting creation of records currently subject to public disclosure laws and requiring the destruction of public records currently in existence. Therefore, it creates an exception to our constitutional right of access. Florida's Constitution requires that exceptions to the right of access under Art. I, s. 24 be (1) in single subject bills; (2) contain a specific statement of public necessity; (3) be narrowly-tailored; and (4) be approved by a 2/3 vote of each chamber. This bill violates the single subject requirement and does not contain the constitutionally-required statement of public necessity. Because the bill lacks a necessity statement, it's difficult to determine whether the legislation is sufficiently narrow in scope.
