HB 1293 (2003) - Certificates of Need

General Bill by Mayfield (CO-SPONSORS) Zapata

Certificates of Need: Eliminates the requirement that an existing health care facility must be in the same district to initiate or intervene in a challenge to the issuance of a certificate of need; requires health care facilities that challenge the issuance of a certificate of need to post bond or establish an escrow account; provides for an award against and recovery from an unsuccessful challenger or intervener of costs, attorney's fees, and revenue losses by successful certificate of need applicants; provides for the award to be made by an administrative law judge and to be enforceable as an agency final order.

Effective Date: This act shall take effect July 1, 2003
