Provides for government acquisition of roads; provides procedures to contest such acquisition; allows local governmental entities to require prequalification of contractors for described transportation facilities construction; provides a condition for ineligibility; provides a presumption of eligibility for contractors prequalified by the Department of Transportation; provides for an appeal process to overcome that presumption; requires publication of prequalification criteria and procedures prior to advertisement or notice of solicitation; requires a public hearing; requires a process for appeal; revises definitions; revises duties of the Department of Transportation; requires the department to establish requirements for airport site approval, licensure, and registration; requires the department to establish and maintain a state aviation facility data system; revises provisions for airport site approval; revises provisions for airport licensing; provides for a private airport registration process; specifies requirements for such licensing and registration; deletes airport license fees; provides for expiration and revocation of such license or registration; revises provisions for exemption from such registration and licensing requirements; exempts described areas and facilities from such requirements; provides described private airports the option to be inspected and licensed by the department; revises provisions for airport zoning protection for public-use airports; extends time period of the department's authorization to fund security-related airport projects; provides that local government regulations shall not apply to transportation facilities on the State Highway System; provides for the department to enter into agreements with other governmental entities to acquire right-of-way; deletes project criteria for such agreements; revises timeframe for department to act on an application for qualification as a contractor; adds testing services to those activities that specified contractors may not qualify to perform; revises basis for determining incentive payments to contractors; deletes limitation on such payments; allows the department under described circumstances to enter into permit-delegation agreements with other governmental entities for issuance of permit to use rights-of-way; deletes an incorrect reference; designates Cesar Calas Way and Firpo Garcia Way in Miami-Dade County; designates Private Robert M. McTureous, Jr., U.S.M.C., Medal of Honor Memorial Highway in Lake County; directs the Department of Transportation to erect suitable markers; repeals s. 83 of ch. 2002-20, Laws of Florida, relating to aid and contributions by governmental entities for department projects.
Effective Date: Except as otherwise provided herein, this act shall take effect upon becoming a law
