HB 1307 (2004) -  Agricultural and Migrant Labor

Requires the Department of Health to adopt rules relating to residential migrant housing; provides guidelines for the filing of interstate clearance orders; revises a provision relating to who may issue certain citations; requires the department to provide notice of suspected violations; clarifies a provision relating to water pollution operation permits; requires the Florida Housing Finance Corporation to utilize federal and state resources in a certain manner; authorizes and directs the Executive Office of the Governor to advise and consult on certain issues relating to migrant workers; directs the office to coordinate enforcement of certain provisions with the Department of Business and Professional Regulation; includes farm labor contractors in the enforcement of certain laws; authorizes and directs the office to cooperate with the Agency for Workforce Innovation in the recruitment and referral of migrant workers and certain other laborers; renames the Legislative Commission on Migrant Labor as the Legislative Commission on Migrant and Seasonal Labor; provides a deadline for appointments to the commission; provides a deadline for the commission's first meeting; revises the membership of the commission's advisory committee; provides a deadline for certain reports; provides a popular name; authorizes the department to enter into certain agreements with the Secretary of Labor of the United States; provides definitions; revises requirements for retaking examinations for renewal of certificates of registration; requires fees for certain programs to be deposited in the Professional Regulation Trust Fund; provides criteria for issuance or renewal of certificates of registration; authorizes payment for certificates of registration by cashier's check; increases the application fee for such registration; requires fees to be deposited in the Professional Regulation Trust Fund; provides criteria for revocation, suspension, or refusal to issue or renew certificates of registration; conforms a provision; provides criteria for permanent revocation or refusal to issue or renew certificates of registration; authorizes the department to inspect certain documents upon receipt and acceptance of a certificate of registration; creates the best practices incentive program for farm labor contractors; requires farm labor contractors to meet certain requirements; authorizes the department to enter into certain partnership agreements; authorizes the department to revoke certain designations; prohibits the unauthorized use of designations; limits certain civil liability of the department; requires the department to establish an incentive program; removes department requirements for the suspension or revocation of farm labor contractors' certificates of registration; requires farm labor contractors to keep certain records; provides certain prohibited acts for farm labor contractors; prohibits certain contracts or employment; provides a penalty; authorizes the department to enter into agreements with other state agencies for certain purposes; provides civil and criminal penalties for minor and major violations; increases certain civil penalties; authorizes payment of certain civil penalties by cashier's check; removes authorization to pay certain civil penalties by cash; increases the scope of where a complaint may be filed; provides for a warning to contractors committing minor violations; provides civil penalties; authorizes the revocation of certificates of registration under certain circumstances; requires the department to provide notice of suspected violations; provides guidelines for the sale of certain commodities to farmworkers; provides penalties; provides a popular name; revises references to make the "Florida Pesticide Law" part I of ch. 487, F.S.; clarifies a provision relating to the labeling and registration of approved pesticides; creates the "Florida Agricultural Worker Safety Act"; provides for administration by the Department of Agriculture and Consumer Services; provides legislative intent; provides definitions; provides enforcement of federal worker protection regulations; requires agricultural employers to make certain pesticide information available; prohibits certain acts; provides penalties; requires monitoring and reporting of complaints; clarifies provisions relating to the definition of the term "pesticide chemical" and duties of the Division of Agricultural Environmental Services, respectively; directs the Division of Statutory Revision to designate parts I and II of ch. 487, F.S.
