Requires copies of adverse incident reports to be forwarded to the Division of Medical Quality Assurance of the Department of Health; provides for costs of copying such records; clarifies access to patient records; provides for costs of copying records; revises the use of patient information for marketing purposes; provides that advanced nurse practitioners are qualified professionals; requires certified copies of records to be provided to the department upon subpoena; reduces inservice training hours for nursing assistants; provides for licensee input to long-range plans for regulation of health professions; provides procedures to resolve differences in interpretation of practice acts by different boards; protects board declaratory statements; requires temporary licenses to be issued according to rules; provides for electronic posting of examination scores; provides for content of continuing education courses; provides requirements for completion of continuing education courses; requires management reports on revenue and expenditures if needed; provides rulemaking authority; clarifies grounds for discipline for performing or attempting to perform health care services on the wrong patient or that are otherwise wrong or unnecessary or leaving a foreign body in the patient; provides for discipline for prescribing, administering, dispensing, or distributing medications without a valid professional relationship; provides for additional costs to be assessed as part of any penalty or other form of discipline; provides prerequisites for training requirements for licensure to practice acupuncture; provides time period for review of application for licensure; provides for a plea of nolo contendere as grounds for discipline; reduces the time period for physicians to respond to information contained in a complaint; provides limit on fees for renewal of registration of resident physicians, interns, and fellows; revises elements of a crime relating to employment and reporting of such persons; revises the name of an accrediting agency; defines the scope of practice of certified nursing assistants; clarifies requirements for criminal history checks; provides for biennial renewal of certification, including fees; revises a ground for disciplinary action for specificity and removal of the requirement of intentionality; provides additional requirements for a community pharmacy permit; prohibits issuance of permits to persons with a related criminal conviction; provides grounds for suspension, revocation, or denial of a permit; removes requirement for each community pharmacy to have a generic drug substitution formulary; provides requirements for electronic prescriptions for brand name drugs; revises requirements for expiration dates of medicinal drugs; requires 4 years of postsecondary dental education to qualify to take the examinations to practice dental hygiene; allows for course in practice management; increases the time that records of work orders for unlicensed persons must be retained; provides for inactive licensure status for midwives pursuant to rule; revises midwifery licensure status and fees; requires a midwife's emergency care plan to be available to the department upon request; revises provisions relating to respiratory therapy licensure and testing requirements; revises exemptions from respiratory therapy licensure requirements; revises requirements for athletic trainers; eliminates teacher trainer exemption; exempts massage therapists from premises licensure; revises requirements for licensure of massage therapists; removesprovisions relating to apprentices; providesadditional requirements for licensure as a massage establishment; prohibits issuance of massage establishment licenses to persons with criminal conviction; requires background checks; prohibits license transfer, with exceptions; reduces opportunities to retake the physical therapist licensure examination; revises provisions for physical therapist licensure by endorsement and reactivating such a license; reducing opportunities to retake physical therapist assistant licensure examination; revises provisions for physical therapist assistant licensure by endorsement and reactivating such a license; exempts out-of-state licensed physical therapists from Florida licensure when in the state temporarily serving athletes; requires direct supervision of clinical experience for licensure; requires completion of clinical experience prior to written examination; permits teaching of a course to count for successful completion; provides for substitution of experience for required course; provides for discipline of certified master social workers by the department; provides protection for disclosure; eliminates provisions for teacher athletic trainers; allowing for relicensure.
