HB 1597 (2005) -  Hydrogen Energy Technology

Creates the Hydrogen Energy Technologies Act; provides a popular name, legislative findings and intent, purpose, and definitions; creates the Hydrogen Energy Technologies Grants Program in the Department of Environmental Protection to provide grants for demonstration, commercialization, research, and development projects relating to hydrogen energy technologies; provides requirements and procedures and rulemaking authority; creates a sales tax exemption for certain hydrogen energy technology projects and provides requirements and procedures therefor; requires the Department of Environmental Protection to make determinations relating to certain projects; authorizes the Department of Revenue to adopt rules for tax exempt purchases; provides for future repeal of the exemption; provides for information sharing between the Department of Revenue and the Department of Environmental Protection; provides for the addition of tax credits relating to hydrogen energy technologies in the priority order of tax credits; creates a hydrogen energy technologies investment tax credit; provides definitions; provides requirements and procedures therefor; authorizes the Department of Revenue to perform certain audits and investigations; requires the Department of Environmental Protection to provide technical assistance in certain audits and investigations; provides for revocation or modification of credits; provides for payment of tax and interest under certain circumstances; provides rulemaking authority; provides for future repeal of the credit; revises the definition of the term "adjusted federal income" to include the amount taken as a credit for expenses related to hydrogen energy technologies; authorizes the Florida Public Service Commission to approve experimental or transitional rates to encourage the use of renewable energy; revises definition of "environmental compliance costs" to include costs related to the deployment of hydrogen energy technologies; provides for cost recovery of utility investment in hydrogen energy technologies; authorizes the State Fire Marshal to adopt uniform standards for hydrogen fueling, storage, and production facilities; provides rulemaking authority.
