HB 1845 (2005) -  Persons with Disabilities

Provides a right to access to reports and records in abuse and neglect cases of by the Agency for Persons with Disabilities; provides duties of the agency; requires the agency to provide notice of services to parties in dependency proceedings; revises membership on the Genetics and Newborn Advisory Screening Council; repeals short title of the Developmental Disabilities Prevention and Community Services Act; requires the agency to provide for family or individual support plans; revises provisions relating to screening of direct service providers, services for persons with developmental disabilities, and licensure of residential facilities and comprehensive transitional education programs; provides penalties for providing or attempting to provide supports or services with direct service providers not in compliance with certain screening requirements; revises provisions relating to receivership proceedings, family care programs, involuntary admission to residential services, review of provider decisions, client rights in residential facilities and in intermediate care facilities, and resident government; revises provisions relating to the prohibition and reporting of sexual misconduct and penalties therefor; provides for a Community Resources Development Loan Program and criteria for eligibility; provides for deposit of funds in the Agency for Health Care Administration Administrative Trust Fund and provides purposes for said funds; creates a comprehensive transitional education program; provides for purpose, duties, staffing, types of services, licensing requirements, and limitation on number of residents served; revises policies and procedures for the administration of medication to persons with developmental disabilities; including the Agency for Health Care Administration on a list of agencies receiving information regarding facilities that have been sanctioned or fined; transfers rulemaking authority for administration of intermediate care facilities for persons with disabilities from the Department of Children and Family Services to the Agency for Persons with Disabilities; provides for the agency to coordinate educational services for students residing in certain residential care facilities; requires the Agency for Health Care Administration to help the Agency for Persons with Disabilities conduct certain assessments; requires certain populations served by the Agency for Persons with Disabilities to be included in a family support plan; requires notification to certain administrative agencies regarding allegations of abuse, neglect, or exploitation; provides that certain confidential reports and records may be released to the agency for certain purposes; requires the agency to notify local government that a community residential home is licensed at the time of occupancy; prohibits the agency form issuing a license to a sponsoring agency not in compliance with notification requirements; requires the Department of Corrections to notify the agency prior to release of a mentally retarded inmate and to cooperate with the agency to ensure delivery of services to certain offenders; requires an inmate to apply for mental retardation services from the agency as a condition of parole; provides for evaluation and referral to the agency for placement of a child with a developmental disability in a staff-secure shelter or physically secure setting; authorizes the court to order a child named in a detention petition or petition for delinquency to be evaluated by the agency; requires district school boards to provide educational programs to students in residential care facilities operated by the agency; provides duties of the agency.
