HB 177 CS (2004) -  Theft

Provides that the theft of a semitrailer deployed by a law enforcement agency is grand theft of the first degree, punishable as a felony of the first degree; provides that it is a felony of the second degree to commit certain acts involving a fifth wheel or altered fifth wheel with the intent to commit or attempt to commit theft; increases the severity ranking of offenses involving cargo theft and provides for the ranking of offenses involving the theft of a semitrailer deployed by a law enforcement agency on the offense severity ranking chart of the Criminal Punishment Code; creates the Statewide Study Commission on Cargo Theft and Trucking Security; requires meetings of the commission be open to the public and held within the state; authorizes reimbursement for travel and per diem expenses for members while carrying out official business of the commission; specifies commission duties; requires the commission to make a report by a specified date; provides for expiration of the commission upon the submission of its report.
Effective Date: July 1, 2004, except that this section and section 1 of this act shall take effect upon becoming a law
