Creates part III of ch. 668, F.S., the "Electronic Mail Communications Act," relating to unsolicited commercial electronic mail; provides legislative intent; provides definitions relating to unsolicited commercial electronic mail; prohibits a person from initiating or assisting in the transmission of unsolicited commercial electronic mail under certain circumstances; prohibits the distribution of software or any other system designed to falsify missing routing information identifying the point of origin or the transmission path of a commercial electronic mail message; provides construction of the act with respect to blocking, transmission, routing, relaying, handling, and storing of certain types of electronic mail messages by providers of Internet access service, the adoption of policies regarding commercial or other electronic mail by such providers, and policies that are unlawful under other provisions of law; authorizes the Department of Legal Affairs to enforce the act; authorizes the department and an interactive computer service, telephone company, or cable provider that handles or retransmits unsolicited electronic mail to bring an action against persons transmitting that mail; provides for declaratory and injunctive relief, compensatory damages, and attorney's fees; declares that persons outside this state are subject to the jurisdiction of this state's courts under specified circumstances; provides a statute-of-limitations period; provides that a violation of the act is an unfair and deceptive trade practice; provides for severability.
