HB 305 CS (2005) -  Wireless Emergency Telephone System

Provides a timeframe for annual audits of the Wireless Emergency Telephone System Fund by the Auditor General; revises fee schedules for providers of interexchange telecommunications services; revises provisions for certain nonemergency telephone number pilot projects; limits application of definitions; adds definitions relating to wireless telephone communications; revises duties of the Wireless 911 Board; provides for grants and loans to certain counties for the purpose of upgrading E911 systems; authorizes the hiring of an executive director and an independent, private attorney; specifies that state and local governments are not customers under provisions for the wireless E911 monthly fee; revises timeframe to reduce the amount of the fee or for reallocation of moneys collected for the fee; provides legislative intent regarding the emergency wireless telephone system; provides standards for local governments to follow when regulating the placement, construction, or modification of a wireless communications facility; revises requirements for collocation of certain facilities; provides for review of collocations under various circumstances and meeting specified requirements under such circumstances; exempts such collocations from certain local regulations; provides for review of certain collocations that do not meet such requirements; revises provisions for compliance with certain requirements by the owner of the existing tower; provides for review for replacement of certain towers to accommodate collocation under certain conditions; provides criteria for local government regulation of wireless communications facilities and review of an application for the placement, construction, or modification of such facilities; authorizes a local government to exclude such facilities; provides for reimbursement to the local government of certain costs; authorizes the local government to impose certain fees and require a surety for certain purposes; directs local governments to grant or deny properly completed applications within specified time periods; provides for approval when time period is exceeded; provides circumstances for extension of such time periods; provides criteria and procedures for local approval of an application by a provider of wireless communications services; prohibits local governments from imposing certain requirements on wireless communications providers; directs local governments to notify a provider in writing of the deficiencies in an application and whether the resubmission of information properly completes the application; provides for a limited review by a local government of an accessory wireless communications facility; provides that an action brought by a person adversely affected by a decision of a local government relating to a wireless communications facility shall be considered on an expedited basis; removes certain complaint procedures; provides for deposit and appropriation of funds received by a county from the E911 fee; provides for audit of such funds; removes a restriction on the county's authority to carry forward such funds; provides a timeframe for annual audits by the Auditor General of the Wireless Emergency Telephone System Fund; revises provisions relating to use of right-of-way for utilities subject to regulation to remove certain application provisions.
