HB 1835 CS (2005) -  Procurement of Contractual Services by an Agency

Creates the "Center for Efficient Government Act"; places the Center for Efficient Government within the Department of Management Services; provides legislative intent; provides that procurements of specified commodities and services are not subject to the act; provides specified applicability; provides definitions; provides criteria for the procurement of contractual services by an agency; creates the Commission on Efficient Government within the Department of Management Services; provides for purpose, membership, and organization of the commission; provides duties and responsibilities of the commission; creates the Center for Efficient Government; provides purpose and organization of the center; provides duties and responsibilities of the center; requires the center to recommend and implement a centralized gate process for reviewing, evaluating, and approving agency projects; requires state agencies to submit specified information, documents, and other materials required under commission rules; specifies procurements which must be reviewed and evaluated under the centralized gate process; provides minimum requirements for the centralized gate process; provides for specified determinations by the commission at each gate; provides procedure with respect to an unfavorable finding by the commission with respect to a procurement required by law; provides that agencies under the individual control of the Attorney General, Chief Financial Officer, or Commissioner of Agriculture are subject to the act, with specified exceptions; provides authority of the agency head with respect to procurements by such agencies; establishes the gates within the centralized gate process; requires agencies to submit specified documents for commission review at each gate; provides for nullification of executed contracts for procurement under specified circumstances; requires the commission to take action at each gate within a specified time period; provides procedure if the commission does not take action within such time period; requires the submission of annual project status reports; provides requirements for procurement of certain contractual services; requires an agency to develop a business case which describes and analyzes a contractual services procurement under consideration; provides that the business case is not subject to challenge or protest under the Administrative Procedure Act; provides required components of a business case; defines "cost" and "savings"; provides requirements with respect to the solicitation for a contractual services procurement; provides contract requirements for a contractual services procurement; provides requirements with respect to contract amendments; prohibits the division of a contract amendment to avoid specified requirements; requires documentation of contractor performance prior to renewal or extension of a contract; provides for conditional supersession of the act; provides a requirement with respect to the composition of persons chosen to conduct negotiations during a specified competitive sealed reply procurement; authorizes the Chief Financial Officer to review contracts for state agencies; permits budgetary changes for a contractual services procurement only under specified conditions; requires the placement of full-time equivalent positions in reserve under certain conditions; provides for the reestablishment of full-time equivalent positions upon termination of a contract and reversion of functions and responsibilities to the agency; provides that only public officers or employees must perform certain functions; provides restrictions on contractor involvement in the procurement of contractual services; provides applicability; provides for future termination of the Center for Efficient Government and the Commission on Efficient Government; provides legislative intent with respect to the performance of review functions and assistance to agencies for procurements of contractual services by state agencies after a specified date; provides that positions authorized under the act shall remain with the Department of Management Services after a specified date; eliminates the State Council on Competitive Government; provides an appropriation and full-time equivalent positions.
