Procurement Contracting:
Creates the 2005 Efficiency in Procurement and Contracting Act; creates the Division of Procurement in the Department of Management Services; establishes bureaus within the division; requires the division to adopt rules and guidelines for certification and disposition of surplus property; applies procurement provisions of the Department of Management Services to the division; creates the Center for Outsourcing within the division; establishes a board to oversee agency outsourcing; provides responsibilities of the center and board; specifies requirements for a state outsourcing review process; requiring agencies to submit information to the center; revises requirements for purchases from purchasing agreements and state term contracts; revises provisions for procurement of commodities or contractual services; requires the division to design, implement, and operate on on-line procurement subsystem; authorizes the division to contract for equipment and services; requires agencies to use the subsystem; authorizes other eligible users to use the subsystem; requires the division to maintain a list of vendors with the on-line procurement subsystem; requires vendors to register; requires the division to maintain a statewide contractor performance system; requires the division to use the subsystem for enforcement purposes; authorizes use of types of contracts; prohibits specified contracts; authorizes the division to collect fees for using an on-line procurement subsystem; specifies fee requirements and limitations; requires the division to maintain a suspended vendor list; specifies list requirements; authorizes the division to reinstate suspended vendors; specifies prohibited activities by suspended vendors; prohibits public entities from engaging in specified activities with suspended vendors; requires competitive solicitations and contract documents to contain an information statement; requires the division to adopt rules to implement contract default procedures; requires the division to submit a report to the Legislature; provides an appropriation and authorizes positions for the division.
