HB 609 (2009) -  Mobile Home Park Lot Tenancies

Authorizes court to refer actions to binding arbitration under certain conditions; deletes provision relating to mobile home park owners increasing rental amounts under certain conditions; revises provisions relating to grounds & proceedings for eviction to require mobile home park owner to apply to local government for change of use or rezoning under specified conditions; deletes provision relating to nonapplicability of certain provisions relating to governmental action affecting removal of mobile home owners; revises provisions relating to homeowners' association's right to purchase park; increases number of days in which contract must be executed for such sale; provides requirements for purchase of park by homeowners' association; provides offer requirements; requires agency of municipal, local, county, or state government to first determine existence of adequate mobile home parks or other monetarily comparable, suitable, & available facilities before approving action which would result in removal or relocation of mobile home owners residing in park.
