HB 433 CS (2003) -  Behavioral Health Services

Requires the Secretary of Children and Family Services to appoint an assistant secretary for behavioral health; provides responsibilities of the assistant secretary; provides for the appointment of a Director of Mental Health Services; provides duties of the director; provides for the appointment of a Director of Substance Abuse Services; provides duties of the director; provides for the establishment of the Behavioral Health Services Board; provides membership of the board; provides duties and responsibilities of the board; provides for an annual evaluation and report; provides for an independent evaluation of substance abuse and mental health programs by the Office of Program Policy Analysis and Government Accountability and the Auditor General; requires a report; provides for the expiration of the board; requires the Agency for Health Care Administration to seek federal approval to contract with a single entity to provide comprehensive behavioral health care services to Medicaid recipients; requires the agency and the Department of Children and Family Services to execute a specified written agreement by a specified date; requires the agency to contract with specified managed care entities to provide comprehensive inpatient and outpatient mental health and substance abuse services through capitated prepaid arrangements to Medicaid recipients; provides requirements with respect to such contracts; requires the agency to submit a plan for the full implemention of capitated prepaid behavioral health care in all areas of the state; provides plan requirements; excludes children residing in specified residential programs of the Department of Children and Family Services from the behaviorial health care prepaid health plan; allows child welfare providers to participate in the network for prepaid behavioral health services; requires the agency and the department to develop a plan for implementing new Medicaid procedure codes for specified services; provides plan requirements; requires approval of the plan by the Legislative Budget Commission prior to implementation; provides rights of the department and the agency to monitor for a specified purpose; provides authority of the department with respect to investigation of complaints and monitoring of providers' compliance; requires the department to file a State Projects Compliance Supplement for behavioral health care services; provides requirements with respect to the monitoring of financial operations of contractors; authorizes the department to contract with a single managing entity or provider network for the delivery of state-funded mental health services; requires the managing entity to coordinate its delivery of mental health and substance abuse services with all prepaid mental health plans in the region or the district; provides contract requirements; provides that payments made to a prepaid limited health services organization by the Agency for Health Care Administration under a contract to provide comprehensive behavioral health care services to Medicaid recipients are not subject to the insurance premium tax; requires the agency to provide the prepaid limited health services organization with a specified certification letter; expands the definition of "emergency medical condition" to include a specified psychiatric condition.

Effective Date: This act shall take effect upon becoming a law.
