HB 1391 CS (2003) -  Dependent Children

Clarifies a right of access to records for certain attorneys and providing a right to access for certain school employees and certain employees and volunteers of a certified domestic violence center; authorizes the Department of Children and Family Services and specified law enforcement agencies to release certain information when a child is under investigation or supervision; provides an exception; provides that persons releasing such information are not subject to civil or criminal penalty for the release; provides standards for background screening of persons seeking approval as relative and nonrelative caregivers of children; enumerates offenses the existence of which will cause disapproval; specifies the date that application of standards for background screening becomes effective; clarifies the screening that must occur for purposes of a child protective investigation, for the placement of a child, and for providing information to the court; requires certain screening of prospective adoptive parents; exempts adoption proceedings initiated under ch. 39, F.S., from certain provisions relating to records checks; provides standards for background screening of persons in a household seeking licensure as a foster home; enumerates offenses the existence of which will cause disapproval; provides for rescreening; imposes a duty upon the licensee; specifies the date that application of the standards for background screening becomes effective; redefines the term "personnel" and deletes the definition of the term "screening"; provides standards for background screening for child-placing and residential child-caring agencies; provides for denial of a license and exclusion from employment; provides for background screening for summer camp personnel; provides an exception; repeals provisions relating to requirements for placement of dependent children; provides for the filing of police reports for missing children in the county or municipality where the child was last seen.
Effective Date: This act shall take effect July 1, 2003
