HB 1891 CS (2003) -  Protection and Delivery of Services to Persons who are Disabled, Vulnerable, or Elderly

Permits administration of medication by certain unlicensed staff for persons with developmental disabilities; provides alternative payment methods for contracts for provision of local substance abuse and mental health programs; provides additional persons which may be given a proxy for the making of health care decisions; provides that a public guardian shall be considered a professional guardian for certain purposes; provides for payment of certain guardianship costs from the guardianship estate; increases professional guardian registrationl fee; requires additional information for registration; transfers certain responsibilities from the Statewide Public Guardianship Office to the Department of Elderly Affairs; authorizes the Department of Elderly Affairs to contract with a not-for-profit entity to register professional guardians; provides that certain educational institutions may act as professional guardians without registering; provides additional regulation of professional guardians; provides that certain financial institutions are exempt from the regulations governing professional guardians; authorizes the court to require guardians to submit to credit history investigations and background screening; provides training requirements for parents appointed as guardians of the proerty of their minor children; allows guardians to employ care managers and disclose confidential information to an ombudsman without court approval; providing that the executive director of the Statewide Public Guardianship Office shall be appointed by the Secretary of Elderly Affairs; removes a limitation on what wards a public guardian may serve; creates the Guardianship Task Force to examine and make recommendations regarding guardianship in this state; provides that certain prior offenses shall be considered in conducting employment screening regardless of date of offense; requires applicants for licensure as a nursing home to provide proof of a legal right to occupy the property; delineates the types and number of deficiencies justifying denial, revocation, or suspension of a license as an assisted living facility; permits alternative methods of providing licensure notices to ceratin care facilites; provides that administrative fines for assisted living facilities or its personnel shall be imposed by AHCA in the manner provided in ch. 120, F.S.; provides for deposit of civil monetary fines in the Quality of Long Term Care Trust Fund; permits financial statements to be submitted for the Gold Seal program; revises training requirements for assisted living facilities; provides for a Medicaid home and community-based waiver for persons with Alzheimer's disease; reinstates provisions governing background screening of persons involved with health care services pools; exempts nursing homes and continuing care facilities from certain financial reporting requirements; requires that licensees of AHCA pay or arrange for payment of amounts owed to the agency by the licensee prior to transfer of the license or issuance of a license to a transferee.
Effective Date: This act shall take effect upon becoming a law
