HB 1903 (2004) -  Administration of the State's Social and Economic Programs

Revises the requirements of a risk assessment conducted by the Department of Children and Family Services; requires the department to develop and implement safety and case plans when determined necessary by such assessment; clarifies intent; eliminates a requirement for a court hearing; provides for citizen reviews; distinguishes a court hearing from a citizen review; includes hearings conducted by the Agency for Health Care Administration in the exception for an administrative law judge to preside over such hearings; provides additional legislative intent relating to individuals with developmental disabilities; provides for additional personnel to be included in screening requirements; requires an employment history check in such screening; requires the developmental services program to provide supports and services; renames the Office of Appeals Hearings and places it in the agency; provides rulemaking authority; authorizes the agency to establish and conduct Medicaid hearings; moves duties from the department to the agency; eliminates a requirement that the department charge fees for services provided to disabled adults; revises a definition; provides for representation by counsel at hearings relating to false report of abuse, neglect, or exploitation of a vulnerable adult; requires notification of this right; corrects the name of a coalition; provides activities to which funds for homeless housing assistance may be allocated; revises the submission deadline of an annual report on homeless programs and services; requires a consistency statement from the designated lead agency with respect to homeless assistance services.
