HB 1759 CS (2004) -  Child Support

Revises a definition; eliminates the requirement that a minor child's social security number be included in a support order; provides for continuation of a support obligation at the same amount after emancipation until any arrearage is satisfied; provides for application to support orders entered before, on, or after July 1, 2004; revises the statement of obligor's rights and notice requirement to include a requirement of continued support; requires an obligor to petition for an administrative hearing; provides for the continuation of a support obligation after emancipation of the minor; provides for application to support orders or income deduction orders entered before, on, or after July 1, 2004; requires the state depository to establish an account for receipt and disbursement of payments upon request of the Department of Revenue; requires the department to provide documentation with such request; provides for types of moneys to be deposited into the Child Support Enforcement Application and Program Revenue Trust Fund; provides for use of such moneys; provides proper venue for administrative hearings; provides exceptions; authorizes use of an alternate voluntary acknowledgment of paternity; requires notice to the noncustodial parent before applying an undistributable support collection to another support order; authorizes the department to establish the liability of an obligor; revises the manner in which a noncustodial parent may request the department to bring proceedings in circuit court; provides requirements for such request; provides that the department shall only be a party to such an action to the extent there are Title IV-D issues; requires the department to file a copy of the initial notice with the depository; requires the depository to provide an account number; revises provisions for coverage of the applicable commissions and fees for liquidation of an obligor's assets; authorizies alternative means for service of process; provides for cooperation in good faith; revises the manner of reimbursement to the clerk of court for court filing fees; removes authorization for Title IV-D agencies to screen applicants; revises the computation of time for notices; provides for repayment agreements; provides for notice by regular mail; deletes the requirement for notice by certified mail; requires the department to develop a data match system; provides requirements for such system; authorizes an insurer to participate in such system; provides methods; requires the department to establish a fee; provides immunity for insurers; authorizes the department to adopt rules.
