Revises various provisions of law relating to the Department of Health, health care, and health-related issues; transfers some tobacco settlement funds to the Biomedical Research Trust Fund; creates the Division of Disability Determinations and renames certain divisions within the Department of Health; provides for investigations of elevated blood lead levels; revises duties of the Department of Health with respect to injury prevention and control and sanitation rules; revises requirements for the release of HIV test results; authorizes state agencies to establish employee health and wellness programs; creates the Review Council for Human Subjects; revises the fees imposed for the licensure of tanning facilities; revises the membership of the Health Information Systems Council; revises the date for submitting an annual plan; clarifies provisions with respect to the screening of newborns; revises requirements for the reporting of sexually transmissible diseases; requires the Department of Health to adopt rules relating to newborns or infants exposed to HIV; revises requirements for the purchase and distribution of insulin by the Department of Health; redefines the term "children with special health care needs" for purposes of the Children's Medical Services Act; revises applicability and scope of the act; revises requirements for program eligibility; requires the referral to the Children's Medical Services network of a newborn having a certain abnormal screening result; establishes and provides requirements for the Florida Infants and Toddlers Early Intervention Program; requires certain federal waivers; transfers to the Department of Health authority for the supervision and management of the Raymond C. Philips Research and Education Unit; limits a patient's access to his or her records when the patient's life or safety is endangered; authorizes the Department of Children and Family Services to contract with the Correctional Medical Authority to conduct surveys of medical services and provide medical quality assurance and improvement assistance at secure confinement and treatment facilities; clarifies access to patient records for professional disciplinary purposes and for research purposes; revises requirements for reports to the Department of Health concerning certain brain or spinal cord injuries; requires copies of records to be provided to the Department of Health upon subpoena; requires certification of copies of records requested pursuant to subpoena or patient release; reduces inservice training hours for nursing assistants; provides for the use of funds generated from interest on certain grant moneys dispensed from the Emergency Medical Services Trust Fund; authorizes electronically submitted applications for certification or recertification as an emergency medical technician or paramedic; removes a provision authorizing a temporary certificate; revises requirements for an identifying insignia; requires submission of information and fingerprints for a criminal history check; requires fees; provides additional grounds for denial of certification or recertification; requires emergency medical services training programs to advise students of certification and regulatory requirements; requires recognition, upon application, of entities approved by the Continuing Education Coordinating Board for Emergency Medical Services for recertification training; provides that paramedics may provide life support services in hospital emergency departments under certain circumstances; revises requirements for mandatory testing of certain buildings and facilities for radon; revises eligibility for certain children to participate in the Healthy Kids program and the Medikids program; provides for electronic posting of examination scores; deletes the requirement for the Department of Health to develop and maintain a continuing education tracking system; provides exemption from registration for community college and university clinics; provides distinction between supervision of administrative services and supervision of health care delivery services; provides exemption from registration for clinical facilities where training is provided by certain medical schools; revises requirements for the reporting of professional liability claims; increases the threshold amount of claims against certain practitioners that represent repeated malpractice; provides professional regulatory boards, or the Department of Health, rulemaking authority for reporting allegations of sexual misconduct; clarifies grounds for discipline for performing or attempting to perform health care services on the wrong patient or that are otherwise wrong or unnecessary or leaving a foreign body in patient; provides for discipline for prescribing medications without a valid professional relationship; provides for additional costs to be assessed as part of any penalty or other form of discipline; requires clear and convincing evidence to revoke or suspend a l
